Terms of Service

These Terms of Service ("Terms") govern your use of the websites, applications, and services provided by Lucky Kettle Studios LLC ("we," "us," or "our"), including NoteKeep (the "Services"). By downloading, accessing, or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

Eligibility and accounts

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Services. You are responsible for keeping your account credentials secure and for all activity that occurs under your account.

Your content

You retain ownership of the notes, checklists, and other content you create using the Services ("Your Content"). You are responsible for Your Content and for ensuring you have the right to store and use it. We do not claim ownership of Your Content and use it only as needed to operate the Services, such as storing and syncing it across your devices.

Acceptable use

You agree not to misuse the Services, including by attempting to disrupt or compromise them, reverse-engineering them except as permitted by law, using them for unlawful purposes, or infringing the rights of others.

Subscriptions and payments

• PRO subscriptions. NoteKeep offers an optional PRO subscription at $1.99 per month or $14.99 per year, with pricing as shown in the app at the time of purchase.
• Billing. Subscriptions are sold and billed through the Apple App Store or Google Play, subject to their terms. Payment is charged to your store account at confirmation of purchase.
• Auto-renewal. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. You can manage or cancel your subscription anytime in your App Store or Google Play account settings.
• Refunds. Refunds are handled by Apple or Google according to their policies. We generally cannot issue refunds directly.

Free tier and advertising

The free tier of NoteKeep is supported by advertising served through Google AdMob. By using the free tier, you agree to the display of ads. Upgrading to PRO removes ads.

Service availability

We work to keep the Services reliable but do not guarantee they will be uninterrupted or error-free. We may modify, suspend, or discontinue features at any time. We recommend keeping your own backups of important content.

Disclaimers

The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Services will meet your requirements or be free of errors.

Limitation of liability

To the fullest extent permitted by law, Lucky Kettle Studios LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Services.

Termination

You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms or use the Services in a way that could cause harm. Provisions that by their nature should survive termination will survive.

Changes to these Terms

We may update these Terms from time to time. We will update the "Last updated" date above and, where appropriate, provide additional notice. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws of the State of Minnesota, USA, without regard to its conflict-of-laws principles, except where applicable law requires otherwise.
